193: Power to restrict water supply

A local government organisation can limit your water supply if you do certain things wrong. They can restrict it however they think is best if:

You break the rules in this part of the law.

You don’t do something this law says you must do about water, pipes, waterworks, or water races.

You don’t follow the local rules about water, pipes, waterworks, water races, or water supply that apply to your land or building.

You don’t do something you agreed to do about your water supply.

You don’t let an enforcement officer in, or you get in their way when they’re doing their job under section 182.

When they limit your water, they can’t make your land or building unhygienic. They also have to follow section 69S of the Health Act 1956 when they restrict your water.

193Power to restrict water supply

  1. The water supply to a person's land or building may be restricted by a local government organisation in any manner it thinks fit if the person—

  2. commits an offence against this subpart; or
    1. fails or refuses to do anything required by this Part in respect of water, water pipes, waterworks, or water races; or
      1. fails to comply with any bylaw of a local authority that relates—
        1. to water, water pipes, waterworks, water races, or water supply; and
          1. to the person's land or building; or
          2. fails or refuses to do anything that he or she has undertaken or agreed to do in respect of the water supply to his or her land or building; or
            1. refuses entry to, or obstructs, an enforcement officer under section 182.
              1. Restriction of the water supply under subsection (1) must not create unsanitary conditions in, or associated with, the land or building.

              2. Restriction of the water supply under subsection (1) is subject to section 69S of the Health Act 1956.
