If you live in or use a property, you can get in trouble with the law if you do certain things wrong. Here’s what you need to know:

You might have to pay a fine if you:

  1. Don’t tell the truth about who owns the property when someone from the local council asks you. This includes not giving the owner’s name or address, or giving the wrong information on purpose.

  2. Don’t let the property owner follow the rules set by the government for that property.

If you’re the owner of the property, you won’t get in trouble for these things if you can show that the person living there or using the property (the occupier) didn’t let you follow the rules.

The fine for doing these things wrong is explained in section 242(2) of this law.

230Offences by occupiers

  1. Every occupier of premises commits an offence and is liable on conviction to the penalty specified in section 242(2) who—

  2. refuses or wilfully omits to disclose or wilfully misstates the name or address of the owner of the premises when requested to do so by an officer of the local authority or by a person acting under the authority of the local authority for the purpose of giving effect to the provisions of this Act or of any other enactment in relation to the premises; or
    1. refuses or neglects to allow the owner of the premises to give effect to the provisions of this Act or of any other enactment in respect of the premises.
      1. The owner is not liable to a fine for a default for which he or she might otherwise be liable if he or she proves that the default was due to the refusal or neglect of the occupier.
