Local Government Act 2002

Regulatory, enforcement, and coercive powers of local authorities - Development contributions - Contributions may be required by territorial authorities

199: Basis on which development contributions may be required

You could also call this:

“When and why you might have to pay extra money to the council for building or changing your property”

You might be asked to pay development contributions when you build or change something on your property. This can happen if your project needs new or bigger community facilities. The local council might have to spend money to provide these facilities for you.

The facilities the council might need to provide are:

  • Parks and other outdoor spaces
  • Things like roads, water pipes, and power lines
  • Buildings and services for the community

The council can ask you to help pay for these facilities, even if they’ve already built them before you started your project. They do this because they expect more people to use these facilities in the future.

When the council decides if you need to pay, they look at how your project affects the community. They also think about how your project, along with other projects in the area, might change things over time.
