Local Government Act 2002

Powers of Minister to act in relation to local authorities - Ministerial powers of assistance and intervention - Minister may appoint Commission

258J: Timing of election following postponed election

You could also call this:

“When to hold the next election if one was delayed”

If the Minister postpones a local election and it happens less than 3 years before the next regular election, the Minister must make a choice. They can decide if the next election should be held at the usual time or if it should be delayed until the one after that.

If the Minister decides to delay it further, a few things will happen:

  1. There won’t be an election at the usual time. Instead, it will happen at the time of the second regular election.

  2. The people who were elected in the postponed election will keep their positions until the second regular election.

  3. However, if someone needs to leave their position early for other reasons, they can do so.

This rule helps to make sure that elections happen in an orderly way, even if there have been delays.
