258J: Timing of election following postponed election

You could also call this:

"What happens to the election date if a local election is postponed"

If the Minister postpones a triennial general election for members of a local authority under section 258I, you need to know what happens next. The Minister must decide when the next election will be held, either on the date of the next triennial election or the one after that.

The next general election for members of the local authority will not be held on the date of the next triennial election, but on the date of the second triennial election. You become a member of the local authority until you vacate office, in accordance with section 116 of the Local Electoral Act 2001, for the second triennial election.

If you are a member, you will hold office until the second triennial election, unless you vacate your office under clause 5 of Schedule 7 of this Act sooner.
