When the Minister is deciding what to do under certain parts of the law, they must talk to the Minister of Commerce and Consumer Affairs. 258MEMinister must consult

  1. The Minister must consult the Minister of Commerce and Consumer Affairs when determining what action, if any, to take under subpart 1 or 1A, including when—

  2. appointing a Ministerial appointee; or
    1. formulating the terms of reference for a Ministerial appointee.
      1. However, the obligation to consult only applies in relation to a significant or persistent failure (or possible failure) to comply with the regulation of water services set out in subpart 12 of Part 4 of the Commerce Act 1986.

      2. When determining what action to take, if any, under this subpart, the Minister may consider any information they receive, including any information provided by the Commerce Commission.
