You are a member of a local board if you are elected according to the Local Electoral Act 2001. You can also be a member if you are appointed by the governing body, but only if an Order in Council says so, and you must be appointed according to section 19EA(1)(c) of the Local Electoral Act 2001. A local board also has a chairperson who is either elected by the members or directly elected by the people in the local board area, depending on what an Order in Council under section 25 says, and according to section 19EB of the Local Electoral Act 2001.

You can be elected as the chairperson using one of the voting systems set out in clause 25(3) and (4) of Schedule 7. The chairperson can also be directly elected by the people in the area, but only if an Order in Council under section 25 says so. This is done according to the Local Electoral Act 2001.

The local board members elect the chairperson from among themselves, or the chairperson is directly elected by the people, depending on the Order in Council. The governing body appoints members according to the Local Electoral Act 2001 if an Order in Council says so. You must follow the rules set out in the Local Electoral Act 2001 to be a member or chairperson of a local board.

48EMembership of local boards

  1. The membership of a local board consists of—

  2. members elected in accordance with the Local Electoral Act 2001; and
    1. if an Order in Council under section 25 so provides, members appointed by the governing body in accordance with section 19EA(1)(c) of the Local Electoral Act 2001; and
      1. a chairperson—
        1. elected by the members of the local board from among themselves using one of the systems of voting set out in clause 25(3) and (4) of Schedule 7; or
          1. if an Order in Council under section 25 so provides, directly elected to that office by the electors of the local board area in accordance with section 19EB of the Local Electoral Act 2001.
