If you want to review a court order to transfer a protection order, you must do this within 10 working days. You cannot extend this 10-day period. When you file for a review, it stops the order from happening until the review is finished.

If you review a transfer order and also appeal to the High Court under section 341, the High Court will hear both cases together. This is unless the High Court thinks it is not practical to do so in your situation. The High Court has to make this decision based on your particular case.

207PReview of order for transfer

  1. Any review proceedings in respect of an order that a protection order be transferred—

  2. must be brought within 10 working days after the date of the order, and the 10-working day period cannot be extended:
    1. operate on and after filing as a stay of the order until the review proceedings are withdrawn or finally determined.
      1. Subsection (3) applies if a person—

      2. brings review proceedings in respect of an order that a protection order be transferred; and
        1. has also appealed to the High Court under section 341 against that order, and the High Court has not yet started to hear the appeal.
          1. If this subsection applies in accordance with subsection (2), the High Court must hear both matters together, unless it considers it impracticable in the particular circumstances of the case to do so.
