If someone who is not a social worker is given some tasks or powers, they might be allowed to pass these tasks or powers to someone else. This can happen in two ways: the person was given the tasks just so they could pass them to someone else, or the chief executive said it was okay for them to pass the tasks to someone else. Before passing any tasks or powers to someone else, the person must make sure the other person is a social worker or meets certain requirements, which are explained in section 7D(2)(a). The person passing the tasks must be satisfied that the other person meets these requirements. They can only pass the tasks if they are sure about this.

7ESubdelegation of functions and powers by delegates who are not social workers

  1. This section applies if a delegation referred to in section 7B or 7C is made to a person—

  2. for the sole purpose of subdelegation (see section 7D(3)); or
    1. to whom the chief executive otherwise gives approval to subdelegate.
      1. A subdelegation by the delegate of a function or power under clause 2(3) of Schedule 6 of the Public Service Act 2020 is subject to subsection (3).

      2. Before subdelegating any function or power to a person, the delegate must be satisfied that the person is a social worker or meets the requirement in section 7D(2)(a).
