66LPurpose of Code for information sharing

  1. The purpose of a Code of Practice for Information Sharing (a Code) is to provide both guidance and direction to child welfare and protection agencies and independent persons about the application of the information sharing provisions in sections 66 to 66K and how disputes about the interpretation and application of those provisions should be resolved.

  2. Without limiting subsection (1), a Code may—

  3. authorise a child welfare and protection agency or a class of child welfare and protection agencies or an independent person or a class of independent persons to exercise 1 or more of the powers or carry out 1 or more of the functions set out in sections 66G to 66J:
    1. contain binding rules about the circumstances in which—
      1. the powers conferred by 1 or more of those sections can be exercised; and
        1. the duties imposed by 1 or more of those sections must or may be carried out; and
        2. specify the conditions to which the exercise of those powers and carrying out of those functions is subject; and
          1. specify how disputes about the interpretation and application of those provisions are to be resolved.
