144Agreement not to be made without consent of child or young person

  1. No agreement may be made under section 140 with respect to a child of or over the age of 12 years or a young person unless—

  2. the child or young person consents to the making of the agreement; and
    1. the consent is recorded.

      2. Before an agreement is entered into under section 140, the wishes of the child or young person shall, where practicable, be ascertained and given due consideration in concluding the terms of the agreement.
