Oranga Tamariki Act 1989

Appeals - Appeals from decisions of Family Court

344: Notice of appeal not to affect orders unless court otherwise directs

You could also call this:

"Appealing a decision doesn't stop it from happening unless a court says so."

Illustration for Oranga Tamariki Act 1989

If you appeal a decision made under the Oranga Tamariki Act 1989, the original order still stands unless the court says otherwise. You can appeal under section 341, but this does not automatically stop the order from being enforced. The order can still be enforced as if no appeal is happening, unless the court making the order says something different.
