Oranga Tamariki Act 1989

Trans-Tasman transfer of protection orders and protection proceedings - Miscellaneous provisions

207ZK: Transfer of court file

You could also call this:

"When a child protection court case moves to a new court, the documents are sent to the new court."

Illustration for Oranga Tamariki Act 1989

When a court is dealing with a case about protecting a child, it makes a file with all the documents. If the case is moved to another court in a different area, the court officer must send all the documents to the new court. This happens if a protection order is made and it is moved to the new court, and if no one is appealing the decision. You need to know that the documents are sent when the time to appeal has ended. The court officer keeps a copy of the documents they send.

The court officer must keep the copies of the documents for as long as they would have kept the originals. This is what the law says you must do when a court case is moved to another court. The law is part of the Oranga Tamariki Act 1989, which was amended by the Children, Young Persons, and Their Families (Trans-Tasman Transfer of Protection Orders and Proceedings) Amendment Act 1999.
