205I: Leave to pay claim after time limitation

If you are a claimant or a candidate, you can ask the District Court to let you pay a claim after the usual time limit. The District Court can make an order to let you pay a claim for election expenses that was sent late, or a claim that was not paid on time, as stated in section 205G(1) or section 205G(2). You can also pay a disputed claim if you did not take action within the time limit stated in section 205H(1)(b).

If the District Court makes an order, any money you pay will be treated as if you paid it on time, according to section 205G(2). You will not be penalised for paying late if you follow the court's order. The court's decision will help you resolve the issue.

205ILeave to pay claim after time limitation

  1. On the application of a claimant or a candidate, the District Court may make an order granting leave to the candidate to pay—

  2. a claim for election expenses sent after the period specified in section 205G(1); or
    1. a claim not paid in the period specified in section 205G(2); or
      1. a disputed claim in respect of which an action was not brought within the period specified in section 205H(1)(b).
        1. Any sum paid by the candidate in accordance with an order made under subsection (1) is to be treated as having been paid within the period specified in section 205G(2).
