If you are a member of the Electoral Commission and you are a Judge, the rules about removing or suspending you are in section 42 of the Crown Entities Act 2004. The rules in section 39(1) of the Crown Entities Act 2004 do not apply to any member of the Electoral Commission. You can be removed from the Electoral Commission if the Governor-General decides you should be, after the House of Representatives has asked for it, and this is only for a good reason, which is called "just cause".

The meaning of "just cause" is the same as in section 40 of the Crown Entities Act 2004. You would be removed for just cause by the Governor-General acting upon an address from the House of Representatives. This rule applies to any member of the Electoral Commission who is not a Judge.

4GPower to remove or suspend members

  1. Section 42 of the Crown Entities Act 2004 applies to any member of the Electoral Commission who is a Judge.

  2. Section 39(1) of the Crown Entities Act 2004 does not apply to any member.

  3. Instead, any member who is not a Judge may be removed for just cause by the Governor-General acting upon an address from the House of Representatives.

  4. Just cause has the same meaning as in section 40 of the Crown Entities Act 2004.
