The Governor-General appoints three members to the Electoral Commission. You have a Chief Electoral Officer, a chairperson, and a deputy chairperson. The Chief Electoral Officer is in charge of the Electoral Commission.

The members of the Electoral Commission make up a board, which is talked about in the Crown Entities Act 2004. When appointing members, the Governor-General must do so, even if it seems to go against what is said in section 28(1)(b) of the Crown Entities Act 2004 or clause 1(2) of Schedule 5 of the Crown Entities Act 2004.

The Governor-General makes these appointments based on a recommendation from the House of Representatives.

4DMembership of Electoral Commission

  1. The Governor-General, on the recommendation of the House of Representatives, must appoint 3 members of the Electoral Commission as follows:

  2. 1 member as the Chief Electoral Officer; and
    1. 1 member as the chairperson; and
      1. 1 member as the deputy chairperson.
        1. The member appointed as the Chief Electoral Officer under subsection (1)(a) is the chief executive of the Electoral Commission.

        2. The members of the Electoral Commission are the board for the purposes of the Crown Entities Act 2004.

        3. Subsection (1) applies despite—

        4. section 28(1)(b) of the Crown Entities Act 2004; and
          1. clause 1(2) of Schedule 5 of the Crown Entities Act 2004.
