If you are a candidate in an election and you want a recount of the votes, or if you file an election petition, you can ask the Electoral Commission to add notes to the list of special voters. You do this by sending the Electoral Commission a notice in writing, and they must add the notes as soon as they can, but only if they get your notice before the Returning Officer sends some packets to the Clerk of the House of Representatives, as required by section 187(1)(b). The Electoral Commission will add notes to show why some special voters' votes were not allowed.

The Electoral Commission must keep the list with the notes, and anyone who is registered to vote in the area can look at the list at the Electoral Commission's office without paying a fee, at any time when the office is open. You can see the reasons why some special voters' votes were not allowed, and you can do this for free. The list is available to you at the Electoral Commission's office during business hours.

188Annotation of list of special voters

  1. A constituency candidate at an election who applies for a recount of the votes or a person who files an election petition may, by notice in writing to the Electoral Commission, require the Electoral Commission forthwith to annotate the list attached to the master roll pursuant to section 187(3): provided that this subsection shall not apply where the Electoral Commission receives the notice after the Returning Officer has forwarded to the Clerk of the House of Representatives the packets required, by section 187(1)(b), to be forwarded to the Clerk of the House of Representatives.

  2. The annotations shall show, in relation to each special voter whose vote is shown on the list as having been disallowed, the reason for the disallowance of the vote.

  3. The annotated list must be held by the Electoral Commission, and any registered elector of the district may inspect the annotated list at the office of the Electoral Commission for the district, without payment of any fee, at any time when the office is open for the transaction of business.
