If you publish an election advertisement, some rules apply. These rules are in Part 6AA and Part 6A of the Electoral Act. They apply whether you are in New Zealand or outside New Zealand, depending on where the person promoting the advertisement is.

If someone breaks the law outside New Zealand, they can still be charged in New Zealand if the Crimes Act 1961 says the offence happened in New Zealand. This does not change the rules for election advertisements. The rules for election advertisements still apply as usual.

3FApplication of Act to conduct outside New Zealand

  1. The provisions of Part 6AA and 6A apply in respect of the publication of an election advertisement—

  2. in New Zealand, in any case where the promoter of the advertisement is outside New Zealand; and
    1. outside New Zealand, in any case where the promoter of the advertisement is in New Zealand.
      1. Subsection (1) does not affect the application of the provisions of this Act (other than those provisions in Parts 6AA and 6A that apply in respect of the publication of an election advertisement) in respect of an offence that under any provision of the Crimes Act 1961 is deemed to be committed in New Zealand.
