When you read about election expenses, donations, and annual financial statements, you need to understand what some words mean. The term "advertising expenses" is explained in section 3E. The term "election advertisement" is explained in section 3A.

When you hear "election expenses", it refers to the costs of advertising for an election advertisement that is published during a certain time and is promoted by a registered promoter. It also includes costs for advertisements that are about both elections and referendums, as explained in section 40 of the Electoral Referendum Act 2010. The term "registered promoter" is explained in section 204A.

It does not matter if the costs are paid before, during, or after the regulated time period, they are still considered election expenses.

Election expenses of registered promoters

206SInterpretation

  1. In this subpart,—

    advertising expenses has the meaning given to it by section 3E

      election advertisement has the meaning given to it by section 3A

        election expenses, in relation to a registered promoter,—

        1. means the advertising expenses incurred in relation to an election advertisement that—
          1. is published, or continues to be published, during the regulated period; and
            1. is promoted by the registered promoter; and
            2. includes, as required by section 40 of the Electoral Referendum Act 2010, any referendum expenses incurred in relation to an advertisement that comprises both—
              1. an election advertisement; and
                1. a referendum advertisement (within the meaning of section 31 of the Electoral Referendum Act 2010)

                registered promoter has the meaning given to it by section 204A.

                1. For the purposes of the definition of election expenses, it is immaterial whether an election expense is paid or incurred before, during, or after the regulated period.
