Accident Compensation Act 2001

Entitlements and related matters - Social rehabilitation

83: Date of entitlement to social rehabilitation

You could also call this:

"When you can start getting help to recover after an accident"

This law talks about when you can start getting help to get better after an accident. The help is called social rehabilitation. Here's what you need to know:

The Corporation (which is like a government helper) will start giving you this help on the day you ask for it. But if they think you'll need the help later, they'll start when you actually need it.

Sometimes, the Corporation might think it wasn't fair to expect you to ask earlier. In that case, they can decide to start helping you from an earlier date that they think is fair for you.

But remember, even if they start helping you earlier, you won't get any extra help that you wouldn't have got if you'd asked earlier.

This rule applies to the help that the Corporation has to give you by law, and also to any extra help they've decided to give you.

83Date of entitlement to social rehabilitation

  2. is liable to provide under section 81; or

      2. the date on which the application for the social rehabilitation is made:
        1. if the need for the social rehabilitation is assessed to arise after the date of the application, the date when it is assessed to arise.
          1. However, if the Corporation considers that, in the claimant's circumstances, it would be unreasonable for the claimant to have made an earlier application, it may begin providing social rehabilitation on and from another date it considers reasonable to the claimant.

          2. Subsection (3) does not entitle a claimant to entitlements that the claimant would not have been entitled to had the application been made earlier.
