362First week compensation for incapacity commencing before 1 April 2002

  1. This section applies to a person who,—

  2. immediately before 1 April 2002, was entitled to compensation under section 76 or section 425 of the Accident Insurance Act 1998; and
    1. on and after 1 April 2002, would have continued to be so entitled had the Accident Insurance Act 1998 not been repealed.
      1. On and after 1 April 2002, the person continues to be entitled to compensation under whichever of those sections applies to him or her.

      2. To avoid doubt, this section does not apply in relation to any period of incapacity that commences on or after 1 April 2002.
