142: Persons entitled to be present and heard at hearing

"Who can attend and speak at a review hearing"

You can be present at a hearing if you're involved in a review. You can bring someone to support you if you want. You can speak for yourself or have someone speak for you.

For all reviews, you can attend if you're the person who asked for the review or if you're from ACC.

If the review is about whether an injury at work is covered or not, more people can come. These include you (if you're the injured person), your employer, and sometimes other employers. Other employers might be invited if the injury happened because of work you did for them in the past.

If you're told about a hearing, you'll get information about where and when it's happening. This is so you can come if you want to.

142Persons entitled to be present and heard at hearing

  1. The following persons are entitled to be present at the hearing, with a representative if they wish, and to be heard at it, either personally or by a representative:

  2. on every review, the applicant and the Corporation:
        1. if the review relates to a decision to accept or decline cover for a work-related personal injury,—
          1. the claimant; and
            1. the claimant's employer; and
              1. in the case of a claim for cover for personal injury under section 30, any employer whose name the reviewer receives from the claimant or from the claimant's employer or from the Corporation so that notice can be given under section 141(3), if the name is that of any other employer of the claimant or any former employer of the claimant.
