In this law, 'payment' means any payment or help with getting better that you can get under this Act. The Department of Corrections can share information with the Accident Compensation Corporation (ACC) to check if you should get a payment and how much you should get.

ACC can ask the Department for information about people who are getting, have gotten, or have asked for a payment. This includes things like your name, address, and other details the Department has about you.

The Department can give this information to someone from ACC who is allowed to have it. ACC and the Department will decide together how to share this information.

From 1 December 2020, the Department can only share this information in two ways. One way is through an agreement that follows the rules in Part 10 of the Privacy Act 1993. The other way is through an approved agreement that follows the rules in subpart 1 of Part 7 of the Privacy Act 2020.

Disclosure of information

280Disclosure of information to Corporation

  1. In this section, unless the context otherwise requires, payment means any payment under this Act; and includes any provisions in respect of rehabilitation.

  2. The purpose of this section is to facilitate the disclosure of information by the Department of Corrections (the Department) to the Corporation for the purpose of verifying—

  3. the entitlement or eligibility of any person to or for any payment; or
    1. the amount of any payment to which any person is or was entitled or for which any person is or was eligible.
      1. For the purpose of this section, the Corporation may from time to time, in accordance with arrangements made between the Corporation and the Department, request the Department to supply, in respect of persons who are receiving, have received, or have applied to receive any payment—

      2. such biographical information as is sufficient to identify those persons, including their addresses; and
        1. such details of those persons held by the Department as are necessary for the purposes of this section; and
          1. such information and details referred to in paragraphs (a) and (b) as may be necessary for the purposes of this section in respect of persons who are receiving, have received, or have applied to receive any rehabilitation.
            1. On receipt of a request made under subsection (3), the Department may supply the information requested to any officer or employee or agent of the Corporation who is authorised in that behalf by the Corporation.

            2. Information supplied under a request made under subsection (3) may be supplied in such form as is determined by agreement between the Corporation and the Department.

            3. On or after 1 December 2020, no information may be disclosed under this section except under—

            4. an information matching agreement entered into under Part 10 of the Privacy Act 1993 and continued by clause 11 of Schedule 1 of the Privacy Act 2020; or
              1. an approved information sharing agreement entered into under subpart 1 of Part 7 of the Privacy Act 2020.
