147: Effect of review decisions

When a decision is made after a review, it affects several people. You and the Corporation must follow this decision. Anyone who has a job to do because of this decision must also follow it. The same goes for anyone else involved in the review.

There are some exceptions to this rule. The Corporation doesn't have to give you benefits that aren't allowed by the law, even if a review decision says so. This can happen when a decision is made automatically because of a delay.

If you're covered by ACC but didn't ask for the review yourself, you won't lose your cover because of an automatic decision. This is true unless you helped cause the delay.

Remember, these rules are there to make sure review decisions are fair and followed properly.

147Effect of review decisions

  1. A review decision is binding on—

  2. the applicant and the Corporation; and
    1. any person who has a responsibility under this Act that is invoked in the decision; and
      1. any other party to the review.
        1. Subsection (1) is subject to subsections (3) and (4).

        2. The Corporation is not liable to provide entitlements as a result of a deemed review decision under section 146 other than those able to be provided under this Act.

        3. A claimant who is not an applicant cannot lose his or her cover as the result of a deemed review decision under section 146, unless he or she caused or contributed to the delay.
