If you asked for help before 1 October 1992, you can get cover if the old 1982 law would have given you cover.

If you asked for help between 1 October 1992 and 30 June 1999, you can get cover if both the 1982 law and the 1992 law would have given you cover.

If you asked for help between 1 July 1999 and 31 March 2002, you can get cover if the 1982 law, the 1992 law, and the 1998 law would all have given you cover.

This law only applies if ACC hadn’t decided about your cover by 1 April 2002. It’s important to remember that the date you were hurt and the date you asked for help both matter in deciding if you can get cover.

356Claim for cover lodged but not yet determined if injury suffered before 1 July 1992

  1. Subsection (2) applies to a claim for cover that—

  2. is for personal injury suffered before 1 July 1992; and
    1. was lodged with the Corporation before 1 October 1992 and before 1 July 1999; and
      1. was not determined before 1 April 2002.
        1. A claimant has cover under this Act only if the claimant would have had cover under the Accident Compensation Act 1982.

        2. Subsection (4) applies to a claim for cover that—

        3. is for personal injury suffered before 1 July 1992; and
          1. was lodged with the Corporation on or after 1 October 1992 and before 1 July 1999; and
            1. was not determined before 1 April 2002.
              1. A claimant has cover under this Act only if the claimant would have had cover under both—

              2. the Accident Compensation Act 1982; and
                1. the Accident Rehabilitation and Compensation Insurance Act 1992.
                  1. Subsection (6) applies to a claim for cover that—

                  2. is for personal injury suffered before 1 July 1992; and
                    1. was lodged with the Corporation on or after 1 July 1999 and before 1 April 2002; and
                      1. was not determined before 1 April 2002.
                        1. A claimant has cover under this Act only if the claimant would have had cover under—

                        2. the Accident Compensation Act 1982; and
                          1. the Accident Rehabilitation and Compensation Insurance Act 1992; and
                            1. the Accident Insurance Act 1998.
