85: Corporation liable to provide vocational rehabilitation

The Accident Compensation Corporation (ACC) has to provide vocational rehabilitation to you if you have been injured and the injury is covered by ACC. This applies if you are getting weekly payments from ACC, or if you're likely to get weekly payments unless you have vocational rehabilitation. It also applies if you're on parental leave.

Even if you're not getting weekly payments anymore because you're getting New Zealand superannuation, ACC still has to provide vocational rehabilitation to you if you would have been entitled to weekly payments without the superannuation.

Vocational rehabilitation is help to get you back to work or to find new work if you can't do your old job because of your injury.

85Corporation liable to provide vocational rehabilitation

  1. The Corporation is liable to provide vocational rehabilitation to a claimant who—

  2. has suffered personal injury for which he or she has cover; and
    1. is—
      1. entitled to weekly compensation; or
        1. likely, unless he or she has vocational rehabilitation, to be entitled to weekly compensation; or
          1. on parental leave.
          2. Despite subsection (1)(b)(i), the Corporation is liable to provide vocational rehabilitation to a person who was entitled to weekly compensation and who would, but for clause 52 of Schedule 1 (relationship between weekly compensation and New Zealand superannuation), continue to be entitled to weekly compensation.
