121: Disentitlement during imprisonment

"No ACC payments or help while you're in prison"

If you're in prison, you won't get certain benefits from the Accident Compensation Corporation (ACC). This means ACC won't give you any help or money from Part 2 or Part 4 of Schedule 1 while you're in prison. ACC also doesn't have to check on you or pay you anything from Part 3 of Schedule 1 while you're in prison.

When this law talks about being 'in prison', it means the same thing as what the Corrections Act 2004 says about being a prisoner in a prison. So, if you're locked up in a place that the Corrections Act calls a prison, this rule applies to you.

121Disentitlement during imprisonment

  1. The Corporation must not provide any entitlements under Part 2 or Part 4 of Schedule 1 to a claimant in respect of any period during which the claimant is a prisoner in any prison.

  2. The Corporation is not required to undertake any assessments or make any payments under Part 3 of Schedule 1 to a claimant while the claimant is a prisoner in any prison.

  3. In this section, prisoner and prison have the same meaning as in section 3(1) of the Corrections Act 2004.
