Accident Compensation Act 2001

Miscellaneous provisions - Situations where previous insurer involved

294: Scope and purpose of sections 295 to 297

You could also call this:

“Rules for when you get hurt more than once and who helps you”

Sections 295 to 297 are about what happens when you get hurt more than once. They apply when you’re already getting money each week from an insurance company because you were hurt before, and then you get hurt again in a way that’s covered by this law.

These sections have a few important goals. They want to make sure you get all the help you need for both your old injury and your new one. They also want to make sure you get this help quickly and keep getting it if you need it.

These sections also create a plan for the insurance company and ACC to figure out who should help you and pay for your care. This includes deciding who should help you get better and who should pay for what.

Finally, these sections recognise that how much each group (the insurance company and ACC) should help depends on how much each injury affects what you need.

Part 9 Miscellaneous provisions
Situations where previous insurer involved

294Scope and purpose of sections 295 to 297

  1. Sections 295 to 297 apply in any case where a claimant is receiving, or is entitled to receive, weekly compensation from an insurer (within the meaning of section 341(1), but not including the Corporation) and suffers a personal injury covered by this Act after the commencement of this Part (the subsequent injury).

  2. The purpose of sections 295 to 297 is to—

  3. ensure that the claimant receives all necessary and appropriate entitlements for the personal injury covered by this Act (the subsequent injury) and the personal injury that gave rise to the entitlement to receive the weekly compensation (the previous injury); and
    1. ensure that those entitlements are provided without delay and, as appropriate, continuously; and
      1. provide a framework within which the insurer and the Corporation can determine the responsibility to provide entitlements, both from the point of view of taking responsibility for the rehabilitation of the claimant and from a financial point of view; and
        1. recognise that appropriate contributions depend on the extent to which each injury contributed to the need for the entitlements or some of them.
