360: Claim for cover under former Acts not lodged until on or after 1 April 2002

If you get hurt before 1 April 2002 but don't ask for help until after that date, there are some rules about whether you can get help. You can only get help if two things are true:

  1. You would be able to get help if you got hurt on or after 1 April 2002.
  2. You would have been able to get help under the rules that were in place when you actually got hurt.

This means that even if you ask for help after 1 April 2002, the rules from when you got hurt still matter. The people in charge will look at both the old and new rules to decide if they can help you.

Cover for personal injury suffered before 1 April 2002

360Claim for cover under former Acts not lodged until on or after 1 April 2002

  1. Subsection (2) applies to a claim for cover, if the claim—

  2. is for personal injury suffered before 1 April 2002; and
    1. is not lodged with the Corporation before 1 April 2002.
      1. A claimant has cover under this Act only if—

      2. the claimant would have had cover under this Act, had the injury occurred on or after 1 April 2002; and
        1. the claimant would have had cover under the Act that was in force at the time that the person suffered the injury.
          1. This section is subject to section 34.
