217: Collection of levies

You need to pay levies when you apply for a motor vehicle licence or a trade plate. This happens when you use the Land Transport Act 1998. You might also have to pay in other ways that are set out in the rules.

If you use fuel, you might have to pay a levy on it. The rules will tell you how to pay this levy. If there are no rules, you pay it along with any other duties on the fuel.

There's also a Motorcycle Safety levy that you pay in the way the rules say.

If someone collects a motor vehicle levy for the Corporation, they must give that money to the Corporation by the end of the next month.

For the fuel levy, if someone collects it for the Corporation, they must pay it as the rules say. If there are no rules, they pay it in the way they agreed with the Corporation.

You don't have to pay a penalty if you can show the Corporation that you didn't use the vehicle on the road during the time you were supposed to pay the levy.

This rule about not paying a penalty doesn't apply to the fuel levy.

217Collection of levies

  1. The levies payable under section 214(1) or (2) are payable on application for a motor vehicle licence under section 244 of the Land Transport Act 1998 or on application for a trade plate under section 262 of that Act (as the case may require) or in any other prescribed manner.

  2. The levy payable under section 213(2)(c) on any fuel is payable—

  3. in the manner prescribed by regulations made under this Act; or
    1. in the absence of regulations for the time being in force for the purpose of paragraph (a), with any excise or excise-equivalent duty that is payable on that fuel.
      1. The Motorcycle Safety levy is payable in the prescribed manner.

      2. Any person who receives any payment of any motor vehicle levy payable to the Corporation must pay that levy to the Corporation not later than the end of the month after the month in which that levy is received.

      3. However, in the case of the levy payable under section 213(2)(c), an agent who collects any amount of the levy on the Corporation's behalf must pay that amount to the Corporation—

      4. in the manner prescribed by regulations made under this Act; or
        1. in the absence of regulations for the time being in force for the purpose of paragraph (a), in the manner agreed by the Corporation and the agent.
          1. No penalty is payable in respect of any amount due under this section if the person satisfies the Corporation that the motor vehicle was not used on a road during the period for which the levy was due but not paid.

          2. Subsection (5) does not apply to the levy payable under section 213(2)(c).
