Designated services and specified services - Determinations for designated access services and specified services - Determination

28: When determination must be prepared

You could also call this:

"When the Commission must make a decision about a service"

Illustration for Telecommunications Act 2001

The Commission has to try really hard to make a determination under section 27. You need to know when they have to do this by. If the determination does not include the price payable for the service, they have to do it within 40 working days.

If the determination includes the price payable for the service, they have to do it within 50 working days. They have to do this after they give written notice under section 25(1)(b). This notice tells you what is going to happen.

If the Commission cannot do what they are supposed to do on time, they have to give written reasons to the people involved. They have to explain why they could not meet the time limit. This is what happens if they try really hard but still cannot do it on time.
