If someone makes a decision under section 27 or section 30M about how much you pay for a service, you can ask for a review of that decision. You can ask for a review of the price you pay for the service.

However, you cannot ask for a review if the price was decided under section 30M and included in the decision under section 30P(1)(a).

A decision made under section 27 or section 30M still applies until a new decision is made about the price. You can also ask for a review of any discount that applies to the service.

42Application

  1. If a determination is made under section 27 or section 30M regarding the price payable for a designated access service, a party to the determination may apply for a review of that part of the determination that relates to the price to be paid for the service.

  2. However, subsection (1) does not apply in relation to a determination made under section 30M if the price to be paid for the service was included in that determination under section 30P(1)(a).

  3. A determination made under section 27 or section 30M continues to have effect and is enforceable pending the making of a pricing review determination.

  4. A party to a determination made under section 27 or section 30M that relates to the price payable for a designated access service may apply for a review of any discount specified in the applicable initial pricing principle for the service.

  5. Subsections (2) and (3) are for the avoidance of doubt.
