98Certain matters not to prevent making of order under section 96

  1. None of the following prevents the court from making an order under section 96:

  2. the fact that any benefit or advantage that the TSO provider obtains, or is likely to obtain, in connection with the TSO instrument is provided by a person other than the Crown:
    1. the fact that services are provided under the TSO instrument to a person other than, or in addition to, the Crown.
