If you are trying a new fibre fixed line access service, the rules in section 201 do not apply. You are trying a new service if it is offered for no more than one year. The agreement you have with the provider must clearly state when the service will end.

202Exceptions from section 201 for trials

  1. Nothing in section 201 applies in relation to a trial of a fibre fixed line access service.

  2. The provision of a service is a trial if the service—

  3. is offered by the provider for no more than 1 year; and
    1. is provided under an agreement with end-users that clearly states the end date for the service; and
      1. is provided to no more than 1,000 end-users over the whole period in which it is offered.
