The law says that statutory rights of access apply for certain periods. You get these rights when a new law called the Regulatory Systems (Economic Development) Amendment Act 2025 is agreed to, and they last for three years after that. The rights apply from the day after the law is agreed to, until the third anniversary of that day, for some fibre optic media installations. You also get rights of access for certain periods if you are exercising ongoing rights to installed fibre optic media, which are specified in section 155ZD. The law also applies to network operators and other technology for a prescribed period.

155HHow long statutory rights of access apply for

  1. The statutory rights of access given by this subpart apply,—

  2. in relation to FTTP service providers and network operators installing fibre optic media, for the period that—
    1. starts on the day after Royal assent of the Regulatory Systems (Economic Development) Amendment Act 2025; and
      1. ends on the day that is the third anniversary of Royal assent of that Act; and
      2. in relation to FTTP service providers and network operators exercising certain ongoing rights of access to installed fibre optic media, for the periods specified in section 155ZD; and
        1. in relation to network operators and installations of prescribed other technology, for the prescribed period.
