155ZTRight for owners of existing works to enter land and carry out fibre optic works

  1. An owner of existing works may enter land on which the works are situated for the purpose of accessing those works and carrying out fibre optic works.

  2. The right of entry is subject to the conditions that the owner of the existing works—

  3. complies with the notice requirements in section 155ZZB(2)(c) to (g); and
    1. provides the landowner with the capability to connect to a fibre-to-the-premises access network (whether by including, when the fibre optic cable is first being deployed on the existing works, a breakout point in a position that the owner of the existing works considers appropriate, or by any other means suitable for ensuring connectability between the landowner’s property and a network); and
      1. provides a single fibre connection to the connection point that meets the relevant requirements in section 155ZU.
        1. The requirements in subsection (2)(b) and (c) do not apply in relation to repurposed fibre.
