If you apply for a determination, you can withdraw your application at any time by sending a written notice to the Commission. You can do this for most types of determinations, except for a standard terms determination or a designated multinetwork determination. When the Commission gets your notice, it must tell all the parties involved that you are withdrawing your application.

The Commission will then stop working on the determination and decide on any costs according to sections 55 and 56. You need to send your notice in writing to the Commission for it to be valid.

54Applicant may withdraw

  1. An applicant in respect of a determination (except a standard terms determination or a designated multinetwork determination) may, at any time, withdraw the application by written notice to the Commission.

  2. If the Commission receives a notice of withdrawal under subsection (1), then it must—

  3. notify all the parties to the determination of the withdrawal; and
    1. cease preparation of the determination concerned; and
      1. determine any costs under sections 55 and 56.
