The Crown has to pay the TSO provider within 30 working days after the final TSO cost calculation is made public. You will see two amounts that the Crown must pay: one is set out in accordance with section 94K(1)(d) and the other is set out in accordance with section 94K(1)(e). The Crown must pay these amounts to the TSO provider.

If the Crown does not pay these amounts on time, it has to pay interest on the amount that is unpaid. The interest rate is the 90-day bank bill rate plus 5%. The Crown pays this interest from the time the amount was due until it is paid.

The Crown is responsible for making these payments to the TSO provider as stated in the law.

94LPayment by the Crown to TSO provider

  1. The Crown must pay to the TSO provider, not later than 30 working days after the date that the final TSO cost calculation determination is publicly notified,—

  2. the amount set out in the final TSO cost calculation determination in accordance with section 94K(1)(d); and
    1. the amount set out in the final TSO cost calculation determination in accordance with section 94K(1)(e).
      1. If the Crown does not pay the total of the amounts referred to in subsection (1) on or before the due date, the Crown must pay the TSO provider interest on the unpaid amount at the 90-day bank bill rate (as at 31 working days after the date on which the final cost calculation determination is publicly notified) plus 5% for the period from the time the amount was due until the time at which it is paid.
