If the Commission makes a standard terms determination for a service, you can ask the access provider to supply the service on those terms. You must ask in writing. The access provider must then supply the service on those terms. You can only ask for this if there is no other agreement in place for the service, or if any agreement is more than 18 months old. If you and the access provider have an agreement that is less than 18 months old, you cannot ask for the service on the standard terms.

30SApplication of standard terms determination

  1. If the Commission has made a standard terms determination for a designated access service or specified service,—

  2. an access seeker of the service may request an access provider in writing to supply the service on the terms specified in that determination; and
    1. the access provider must comply with the request.
      1. However, subsection (1) does not apply if,—

      2. after the date on which the standard terms determination for the service was made, the access seeker and the access provider entered into an agreement for the supply of the service; and
        1. it is less than 18 months since the date on which that agreement came into force.
