When you apply under section 43, the Commission might ask an access provider to work out the price for a service. The access provider must do this by the time the Commission says. They have to follow the rules that apply to working out the price, which might include clause 2 or clause 3 of Schedule 1.

You need to know that the access provider must give the Commission a statement explaining how they worked out the price. They also have to give the Commission all the information they used to work out the price. This is all part of what the Commission requires when you apply under section 43.

The access provider has to follow any other requirements that might be set out in subpart 1 of Part 2 of Schedule 1 when working out the price.

45Access provider to calculate price on request

  1. On receiving an application made in accordance with section 43, the Commission may, by notice in writing, require an access provider to calculate the price payable for the designated access service.

  2. If an access provider is requested, under subsection (1), to calculate the price payable for the designated access service, an access provider must, not later than the time specified by the Commission,—

  3. calculate that price in accordance with—
    1. the applicable final pricing principle (as affected, if at all, by clause 2 or clause 3 of Schedule 1); and
      1. any regulations that relate to the applicable final pricing principle or, if there are no regulations, any requirements of the Commission:
      2. provide to the Commission—
        1. a statement that sets out how the price was calculated; and
          1. all information on which the calculation of the price was based.
          2. Subsection (2) is subject to the requirement (if any) set out in subpart 1 of Part 2 of Schedule 1 in respect of the applicable final pricing principle.
