If you are a TSO provider who has to give telecommunications services to end-users, this section applies to you. You will know this is the case if you get a copy of a notice under section 94(3). Within 60 days of getting this notice, you must give the Commission some information. You must give the Commission calculations of your net revenue for the financial year. You also need to give the Commission a report from a qualified auditor that says whether your calculations are correct according to any rules and requirements of the Commission. The auditor's report must check if your calculations follow any prescribed requirements and any requirements of the Commission.

94EACalculations of net revenue and auditor's report must be given to Commission

  1. This section applies to a TSO provider under a deemed TSO instrument that requires the TSO provider to provide a telecommunications service to end-users and who is served with a copy of a notice under section 94(3).

  2. Not later than 60 days after receiving the copy of the notice served under section 94(3), a TSO provider to whom this section applies must provide to the Commission—

  3. calculations of the net revenue of the TSO provider for the financial year; and
    1. a report prepared by a qualified auditor that includes a statement of whether the calculations comply with—
      1. any prescribed requirements relating to those calculations; and
        1. any requirements of the Commission.
