155ZEConditions of ongoing rights
The rights of access given by section 155ZD are subject to the following conditions:
- entry to the property must be made only by a person who—
- is an officer, employee, or agent of the FTTP service provider or network operator; and
- is authorised by the service provider or network operator, in writing, to make that entry; and
- is an officer, employee, or agent of the FTTP service provider or network operator; and
- the owner and the occupier of the property must be given reasonable notice of the intention to enter the property; and
- entry must be made at reasonable times; and
- the person entering must produce evidence of his or her authority and identity, if asked to do so; and
- the property must be reinstated as provided in section 155ZB.
The conditions in subsection (1) do not apply if entry on the land is—
- necessary in circumstances of probable danger to life or property; or
- immediately necessary to maintain the continuity or safety of the supply of telecommunications.
