If you have rights to access installed fibre infrastructure under section 155ZD, there are some conditions you must follow. You can only enter the property if you are an officer, employee, or agent of the fibre service provider or network operator, and you have written permission to enter. You must also give the property owner and occupier reasonable notice of your intention to enter, and you can only enter at reasonable times.

When you enter the property, you must be able to show proof of your identity and authority if asked. After you have finished, you must leave the property in the same condition as when you arrived, as set out in section 155ZB. However, if there is a danger to life or property, or if you need to enter the property to keep the telecommunications supply safe and continuous, these conditions do not apply.

155ZEConditions of ongoing rights

  1. The rights of access given by section 155ZD are subject to the following conditions:

  2. entry to the property must be made only by a person who—
    1. is an officer, employee, or agent of the FTTP service provider or network operator; and
      1. is authorised by the service provider or network operator, in writing, to make that entry; and
      2. the owner and the occupier of the property must be given reasonable notice of the intention to enter the property; and
        1. entry must be made at reasonable times; and
          1. the person entering must produce evidence of his or her authority and identity, if asked to do so; and
            1. the property must be reinstated as provided in section 155ZB.
              1. The conditions in subsection (1) do not apply if entry on the land is—

              2. necessary in circumstances of probable danger to life or property; or
                1. immediately necessary to maintain the continuity or safety of the supply of telecommunications.
