69Q: Variations to, and removals from, register

The Commission can review and correct the register at any time. You can find out more about the register in section 69P. The Commission can also remove users from the register if it is no longer satisfied with the information in section 69P(5), or if the user has gone out of business.

If the Commission wants to remove a user from the register, it must tell Chorus and the user first. The Commission must give them a chance to comment before removing the user's name. After the name is removed, the Commission must tell Chorus and the user as soon as possible.

If a user's name is removed from the register, Chorus can still supply services to the user for six months without breaking the rules in section 69O.

69QVariations to, and removals from, register

  1. The Commission may, at any time,—

  2. review and correct the register maintained under section 69P; and
    1. remove the names of users from the register if—
      1. the Commission ceases to be satisfied of the matters in section 69P(5); or
        1. the Commission is satisfied that the user is insolvent or has ceased business.
        2. However, the Commission must give Chorus and the user—

        3. notice of its intention to remove the user from the register, and a reasonable opportunity to comment before removing a name from the register; and
          1. notice that the name has been removed, as soon as practicable after removal.
            1. Chorus is not in breach of section 69O to the extent that it continues to supply a service to a user within the 6-month period following the removal of the user's name from the register.
