If a decision is made under section 27 for a service, and that decision is still in force when a standard terms decision is made for the service, you need to know what happens next. You can ask the service provider to give you the service using the terms in the standard terms decision. The service provider must do what you ask.

When the service provider starts giving you the service using the new terms, the old decision made under section 27 will no longer apply. The service provider has to follow your request to use the new terms.

You make this request in writing to the service provider, and they must comply with your request to supply the service on the terms specified in the standard terms determination, as per the decision made under section 27.

30TEffect of standard terms determination on determination made under section 27

  1. This section applies if—

  2. a determination for a designated access service or specified service is made under section 27; and
    1. that determination is still in force at the time a standard terms determination is made for the service.
      1. An access seeker of the service who is a party to the determination made under section 27 may request the access provider in writing to supply the service on the terms specified in the standard terms determination.

      2. The access provider must comply with the request.

      3. The determination made under section 27 expires on the date on which the access provider begins to supply the service on the terms specified in the standard terms determination.
