89: Payment by liable persons to the Crown

If you are a liable person, you must pay the Crown the amount stated in the determination. You need to pay this amount within 20 working days after the determination is publicly notified, as set out in section 88(b).

If you do not pay the amount on or before the due date, you will have to pay the Crown back as a debt, and you will also have to pay interest on the amount you owe. The interest rate will be the 90-day bank bill rate plus 5%, and you will have to pay this interest from the time the amount was due until you pay it.

The Crown cannot charge you interest on the interest you owe, according to subsection (2) of this provision.

89Payment by liable persons to the Crown

  1. Each liable person must pay to the Crown the amount set out in the determination in accordance with section 88(b) not later than 20 working days after the date that the determination is publicly notified.

  2. If that amount is not paid on or before the due date,—

  3. it is recoverable in any court of competent jurisdiction as a debt due to the Crown; and
    1. the liable person must pay the Crown interest on the unpaid amount at the 90-day bank bill rate (as at 21 working days after the date on which the determination is publicly notified) plus 5% for the period from the time the amount was due until the time at which it is paid.
      1. Subsection (2) does not authorise the imposing of interest on interest.
