Maritime Transport Act 1994

Maritime New Zealand - General provisions

444: Delegation of Director’s functions or powers to persons outside Authority

You could also call this:

"The Director can give some jobs to people outside their team, with the Minister's approval."

Illustration for Maritime Transport Act 1994

The Director can give some of their jobs or powers to people outside the Authority. You need to know the Director can only do this if it is written down. The Minister must agree to this in writing. The Director cannot give away some important jobs, like revoking maritime documents, suspending seafarers, or detaining ships. If the Director gives someone a job, that person must show proof of their authority when asked. They can also charge a reasonable fee for doing the job. The Director can give jobs to a specific person, a group of people, or someone with a specific role. These jobs are only given for a certain amount of time and can be taken away at any time. The person doing the job must follow the rules and get approval from the Minister if needed. You can read more about this in the Crown Entities Act 2004, specifically sections 73(4) and 74 to 76. The Director and the person doing the job must act fairly and follow the rules. If you have any questions, you can ask the Director or the Minister for more information.
