You commit an offence if you operate, maintain, or service a ship or maritime product in a way that causes unnecessary danger to people or property. You also commit an offence if you do any other act with a ship or maritime product that causes unnecessary danger. This applies even if no one is hurt or nothing is damaged. You commit an offence if you cause or let someone operate, maintain, or service a ship or maritime product in a way that causes unnecessary danger. This also applies if you cause or let someone do any other act with a ship or maritime product that causes unnecessary danger. Again, this applies even if no one is hurt or nothing is damaged. If you commit one of these offences, you can be punished with imprisonment or a fine when you are convicted. 65Dangerous activity involving ships or maritime products

  1. Every person commits an offence who—

  2. operates, maintains, or services; or
    1. does any other act in respect of—
      1. any ship or maritime product in a manner which causes unnecessary danger or risk to any other person or to any property, irrespective of whether or not in fact any injury or damage occurs.

      2. Every person commits an offence who—

      3. causes or permits any ship or maritime product to be operated, maintained, or serviced; or
        1. causes or permits any other act to be done in respect of any ship or maritime product,—
          1. in a manner which causes unnecessary danger or risk to any other person or to any property, irrespective of whether or not in fact any injury or damage occurs.

          2. Every person who commits an offence against subsection (1) or subsection (2) is liable on conviction,—

          3. in the case of an individual, to imprisonment for a term not exceeding 12 months or a fine not exceeding $10,000:
            1. in the case of a body corporate, to a fine not exceeding $100,000:
              1. in any case, to an additional penalty under section 409.
