If you operate a ship without the right number of seafarers or qualified personnel, you commit an offence. You also commit an offence if you operate a ship outside its allowed operating limits. You commit an offence if you knowingly break any rules for carrying dangerous goods.

If you commit one of these offences, you can be punished. As an individual, you can be imprisoned for up to 12 months or fined up to $10,000. As a company, you can be fined up to $100,000. You may also have to pay an additional penalty under section 409, unless you have an exemption given under section 40AA.

67BOther offences

  1. Subject to an exemption given under section 40AA, every person commits an offence who—

  2. operates a ship without the prescribed number of seafarers or qualified personnel:
    1. operates a ship outside its prescribed operating limits:
      1. knowingly breaches any requirement specified in this Act or in regulations or rules made under this Act for the carriage of dangerous goods.
        1. Every person who commits an offence against subsection (1)(a), (b), or (c) is liable,—

        2. in the case of an individual, to imprisonment for a term not exceeding 12 months or a fine not exceeding $10,000:
          1. in the case of a body corporate, to a fine not exceeding $100,000:
            1. in either case, to an additional penalty under section 409.
