70: Failure to comply with inspection or audit request

If you do not comply with the Director's request under section 54 without a good reason, you commit an offence. You can be fined if you do this. The fine depends on whether you are an individual or a company.

If you are an individual, you can be fined up to $10,000, and if you keep committing the offence, you can be fined an extra $2,000 for each day. If you are a company, you can be fined up to $100,000, and if you keep committing the offence, you can be fined an extra $20,000 for each day. You may also have to pay an additional penalty under section 409.

70Failure to comply with inspection or audit request

  1. Every person commits an offence who, without reasonable excuse, fails to comply with any requirement of the Director under subsection (1) or subsection (3) of section 54.

  2. Every person who commits an offence against subsection (1) is liable on conviction,—

  3. in the case of an individual, to a fine not exceeding $10,000 and, if the offence is a continuing one, to a further fine not exceeding $2,000 for every day or part of a day during which the offence is continued:
    1. in the case of a body corporate, to a fine not exceeding $100,000 and, if the offence is a continuing one, to a further fine not exceeding $20,000 for every day or part of a day during which the offence is continued:
      1. in any case, to an additional penalty under section 409.
