21: Pleasure craft departing for overseas

If you are the master of a pleasure craft, you must not let it leave a New Zealand port for overseas unless you have done a few things. You must tell the Director in writing about the trip and who is in charge of the craft. The Director must also be happy that the craft and its safety equipment are good enough for the trip, and that it has enough crew. You and the craft must also follow any relevant maritime rules. You will not get a certificate to leave a New Zealand port under the Customs and Excise Act 2018 unless you have met these requirements. The Director has to be satisfied with your plans before you can leave New Zealand.

General duties

21Pleasure craft departing for overseas

  1. No master of a pleasure craft shall permit that pleasure craft to depart from any port in New Zealand for any place outside New Zealand unless—

  2. the Director has been notified in writing of the proposed voyage and the full name of the person who is in command of the pleasure craft; and
    1. the Director is satisfied that the pleasure craft and its safety equipment are adequate for the voyage; and
      1. the Director is satisfied that the pleasure craft is adequately crewed for the voyage; and
        1. the pleasure craft and the master comply with any relevant maritime rules.
          1. No pleasure craft shall be entitled to a certificate of clearance to depart from any port in New Zealand under the Customs and Excise Act 2018 unless subsection (1) has been satisfied.
