Further regulation of maritime activity - Maritime rules

36A: Power of Governor-General to make maritime rules

You could also call this:

"The Governor-General can create maritime rules with the Minister's advice to help keep our seas safe"

The Governor-General can make maritime rules on the recommendation of the Minister. You need to know that the Minister can also make these rules, and the Governor-General's rules are for the same purposes. The Governor-General's rules are made by an Order in Council.

The Governor-General's order is secondary legislation, which means it is a type of law, and you can find out more about publication requirements in Part 3 of the Legislation Act 2019. This order is not drafted by the PCO under section 67(d)(i) of that Act. The Governor-General and the Minister have some powers to amend or revoke each other's maritime rules.

The Governor-General can amend or revoke any maritime rule made by the Minister, and the Minister can amend or revoke any maritime rule made by the Governor-General. This means they can change or cancel each other's rules as if they had made the rule themselves. You can find more information about how these rules are made and changed.
